The class will be presented live in Exton and by web conference in the other locations.

Program:

A comprehensive review of the emerging liability issues that are now arising as a result of underwriting risks in a "soft" market. The course will examine the issues from the perspective of the insured, broker and the insurer. Particular focus will be placed on how to avoid liability problems. Once such liabilities become a reality, ways to deal with such liabilities will be analyzed as well.

  • The duties a broker owes to the insured and insurer
  • The role of the broker as distinguished from an "insurance consultant"
  • The duties of an insured to provide complete and accurate information
  • Broker's duty to convey accurate information to the insurer
  • Documentation issues between the insured, broker and insurer
  • Insurer insolvencies
  • The broker's "Proposal" to the insured
  • The role of the broker's claims department
