1609-X and Omissions Box Frequently Asked Questions
The "Omissions" box was added to waive the late fee and the "1609-X" form was added for 1609-SLL/1609-PR filings that were never made and are required. Refer to the 2/22/2010 Bulletin for information. The Omissions box must be checked to waive the late fee. If a filing incurs a late fee because the Omissions box was not checked, the Omissions box cannot be checked in a future revision because the filing is already late and the late fee is non-refundable.

1. I compared my records against the PSLA Electronic Filing System database and found that the database is missing a filing. How do I enter the missing filing without incurring a late fee if I have the required information?

Log into EFS, use the “Submit Original Filing” function, select the filing type, check the “Omissions” box, and type the text “submitting a missing filing” in the description. The late fee is waived if the Omissions box is checked.
2. I received notification from PSLA that I need to submit individual filings in addition to the 1620 Monthly Report. I didn’t realize I had to enter individual filings in Pennsylvania. How do I enter the missing 1609-SLL/1609-PR filings without incurring a late fee if I don't have all of the needed information?

Review the Pennsylvania Surplus Lines Law to determine if you have the information needed to use an existing filing type.

If you don’t have the needed information for an existing filing type, use the “Submit Original Filing” function, select the “1609-X” filing type, check the “Omissions” box, and enter the text “submitting a missing filing” in the description. The late fee is waived if the Omissions box is checked.

The late fee is waived if the Omissions box is checked.
4. Why am I receiving the error “Cannot Select Omissions if Filing was Already Late”?

The objective of the Omissions box is to encourage agencies to reconcile their own records against the PSLA electronic filing system database. Agencies may submit missing filings during the temporary moratorium and the Omissions box will waive the late fee.

The Omissions box cannot be used to remove the late fee on an existing filing that was already late.
5 Why am I receiving the error “Invalid Policy Effective Date for Omissions”?
- The objective of the Omissions box is to encourage agencies to reconcile their own historical records against the PSLA electronic filing system database. Agencies may submit missing filings during the temporary moratorium and the Omissions box will waive the late fee.
- Per the 2/22/2010 Bulletin, the Omissions box can only be used if the Policy Effective Date is prior to 1/1/2010. It cannot be used to waive the late fee on current filings.
6 How do I check the Omissions box if I use XML Import?
- The Omissions box can only be used via the Submit Filing web page to ensure the user reviews the warning messages prior to submittal. It cannot be used with XML Import
- Similarly, the 1609-X form can only be used via the Submit Filing web page and it cannot be used with XML Import.
7. Whenever I select the Omissions box, I am forced to enter a description. What should I enter?

You should enter the reason why the Omissions box was selected. The reason will be made available to the Pennsylvania Insurance Department.
