PRIVACY STATEMENT FOR
The Pennsylvania Surplus Lines Association (“PSLA”) is the advisory organization designated by the Pennsylvania Insurance Department (“PID”) pursuant to statutory authority set forth in the Surplus Lines Law, i.e., the Insurance Company Law of 1921, Act of May 17, 1921, P.L. 682, No. 284, 40 P.S. §§ 991.1601 et seq., as amended. PSLA’s functions are to process all policies written to cover any insurance of risks resident, located or to be performed in the Commonwealth, permitted to be placed through a surplus lines licensee with a nonadmitted insurer eligible to accept such insurance, other than reinsurance, wet marine and transportation insurance, independently procured insurance, life and health insurance annuities, and coverage obtained from risk retention groups under the Risk Retention Amendments of 1986 (Public Law -563, 100 Stat.3170) accompanied by the appropriate filing and stamping fee. The PSLA further disseminates general information about the Surplus Lines Law. PSLA has created this Privacy Statement in order to demonstrate our firm commitment to privacy for our constituents and our membership. The following paragraphs disclose certain of our information gathering and dissemination practices. COLLECTION, USE AND RETENTION OF INFORMATION We limit the collection, use and retention of information to what we believe is necessary to administer our business, to provide you with exceptional quality service, to comply with regulatory retention of information requirements, and to make available to you, other services and opportunities that may be of benefit or interest to you. PROTECTION OF INFORMATION CONFIDENTIAL BY LAW All documentation, data and records received or produced by the PSLA are the property of the PID. The PSLA maintains the documentation, data and records for the PID and acknowledges confidentiality requirements established by law. Certain information, such as the written declarations required pursuant to 40 P.S. §991.1609(a)(1), is available for public inspection. We will safeguard, according to prudent security standards, information considered confidential by law. A fundamental element of safeguarding such information is to provide protection against unauthorized access or use of this information. In this light we maintain physical, electronic and procedural safeguards that comply with federal guidelines to guard your information against unauthorized access or use. For example, our employees are limited in the access they have to information about you for what is reasonably necessary to complete PSLA’s responsibilities. PSLA will continue to enhance and maintain prudent security standards and procedures to protect against unauthorized access or use of your information and records for as long as the information is retained. E-MAIL PRIVACY Are you interested in PSLA events, publications, seminars, and updates? Would you like to hear about PSLA member benefits and services? Send us your e-mail address and we will send you the latest information about these matters through e-mails designed to meet your needs. Your e-mail address will only be used within PSLA. We do not sell, rent or otherwise disseminate e-mail addresses to anyone. E-MAIL INFORMATION GATHERED BY PSLA For some e-mails distributed by PSLA, specific information on recipient responses is collected. For example, we sometimes review how many recipients open and subsequently chose to click through the links provided in an e-mail. We use this information only for the purpose of analyzing areas of interest, improving our service and enhancing the usefulness of our website. None of this information is sold or distributed outside of PSLA in any manner. PSLA’S SUPPORT LEVEL AGREEMENT PSLA is committed to providing 100% availability of its internet site and e-mail aliasing service. We have implemented safeguards and alarms to notify us in the event of loss of internet connectivity to the backbone and of hardware failures. Even with these safeguards in place, loss of connectivity or hardware failure can still occur. For this reason, PSLA cannot “guarantee” its internet connectivity, nor can we be responsible for lost or delayed requests, e-mail or content.
